Fingal County Council has been designated as the Competent Authority for the purposes of aircraft noise regulation at Dublin Airport.
Fingal County Council has been designated as the Competent Authority for the purposes of aircraft noise regulation at Dublin Airport by the Aircraft Noise (Dublin Airport) Regulation Act 2019. This legislation gives further effect to Regulation (EU) 598/2014 which applies to airports with more than 50,000 civil aircraft movements per calendar year. Dublin Airport is the only airport in Ireland meeting this threshold.
What we do
The Competent Authority is responsible for ensuring that noise generated by aircraft activity at Dublin Airport is assessed in accordance with EU and Irish legislation and for the application of the Balanced Approach to aircraft noise management where a noise problem or potential noise problem at the Airport is identified.
The decision of the Competent Authority is called a regulatory decision and can only be made after a prescribed public consultation process. The regulatory decision can be appealed to An Bord Pleanála.
The Competent Authority has exclusive competence to impose, revoke, revoke and replace, or amend the terms of, an operating restriction.
Before introducing an operating restriction, the Competent Authority has to give advance notice to the EU Commission.
Aircraft Noise Complaints
The Competent Authority does NOT deal with aircrft noise complaints. These should continue to be made to the Dublin Airport Authority at:
Background to Legislation
Regulation (EU) 598/2014 lays down, where a noise problem has been identified, rules on the process to be followed for the introduction of noise-related operating restrictions in a consistent manner on an airport-by-airport basis, so as to help improve the noise climate and to limit or reduce the number of people significantly affected by potentially harmful effects of aircraft noise, in accordance with the Balanced Approach developed by the International Civil Aviation Organisation (ICAO).
The Balanced Approach to aircraft noise management developed by ICAO is an approach to managing noise at an airport that consists of identifying the noise problem at an airport and then analysing the various measures available to reduce noise through the exploration of four principal elements, namely, reduction at source, land use planning and management, noise abatement operational procedures and operating restrictions, with the goal of addressing the noise problem in the most cost effective manner. Operating restrictions are not to be applied as a first resort but only after consideration of the other measures of the Balanced Approach.
Fingal County Council is currently establishing the Competent Authority. This website will be further updated as this process develops.
